【Abstract】The lack of occupational injury protection for employees in the new Business forms has become one of the social pain points in the new era of China. This problem is characterized by the impact and deconstruction of the new labor relationship of "platform + individual" on the occupational injury system of traditional industrial society, and the essence is the division and definition of occupational injury protection platform and individual liability under the new business economy. Under the constraints of the dual goals of resolving the occupational risks of practitioners and promoting the development of the new business economy, the dynamic balance between system financing and payment should be achieved through the planning and design of the core elements of the occupational injury insurance system for new business practitioners. Under the current circumstances, the full coverage of occupational injury protection for practitioners in the new business format will be achieved through commercial insurance, and then the pilot will be carried out along the promotion path of "creation" and "inclusion", and finally the experience of occupational injury protection will be condensed from the aspects of responsibility division, system supply, payment system, treatment level and management handling, and promoted nationwide.
